February 2019: Wire Act Lawsuits Pile Up

Pushback is immediate and wide-ranging.

  • Lottery stakeholders representing nearly every US state draft a letter of opposition.
  • Attorneys general of New Jersey and Pennsylvania send a joint letter to the DOJ expressing “strong objections” to the new opinion.
  • NJ AG Gurbir Grewal  files a Freedom of Information Act (FOIA) request seeking documents that may tie Adelson to lobbying efforts that spawned the opinion.

The most consequential action, though, is the New Hampshire Lottery Commission filing a federal lawsuit against the DOJ.  The filing makes a strong case against the new opinion, and the battle over the Wire Act will be fought in the First Circuit.
